Background: The FCC today adopted a Notice of Proposed Rulemaking (NPRM) to seek comment about enabling model-based rate-of-return carriers to elect incentive regulation for their lower-speed business data services offerings, and emoving ex ante pricing regulation for packet-based and higher-speed circuit-based offerings.

“The Commission’s adoption of the NPRM to seek comment to allow A-CAM electing companies the option of moving to more efficient incentive regulation would be a win for both consumers and providers if adopted. By reducing unnecessary regulatory burdens on some smaller carriers, the agency is paving the way for America’s rural consumers and businesses to access more efficient and innovative broadband services.”
