Even as the Trump Administration FTC has pulled back on regulation, it has pushed forward—and expanded—some of the prior Administration’s consumer-protection policies, using enforcement actions rather than rulemaking. Even after the “Click to Cancel” rule was struck down, the Trump FTC is bringing significant new cases involving subscription services and cancellation practices. It is also prioritizing enforcement on undisclosed fees, kids’ online privacy, and advertising and marketing representations, advancing broad readings of existing statutes while pursuing litigation and growing its partnerships with State Attorneys General. For broadband providers, this means the FTC—not just the FCC—can still shape expectations through case-by-case enforcement.
